End User Phone Numbers (Collected on Your Behalf):

  • We process End User phone numbers as a data processor on your behalf; you are the data controller
6.3 SMS/Text Messaging Practices

Consent Requirements: All SMS/text messages sent through our Platform require proper consent from the recipient. As a Customer using our Communications Services, you represent and warrant that:

  • You have obtained express written consent from each recipient before sending marketing or promotional text messages
  • You have obtained at minimum express consent for transactional or informational messages
  • Your consent collection methods comply with the Telephone Consumer Protection Act (TCPA), CTIA guidelines, and all applicable carrier requirements
  • You maintain records of consent that include: the phone number, date/time of consent, method of consent, and the specific messaging program(s) consented to

Message Content and Frequency:

  • All messaging campaigns must clearly identify you (the sender) in the message content
  • Marketing messages must include opt-out instructions (e.g., "Reply STOP to unsubscribe")
  • Message frequency must match what was disclosed at the time of consent
  • "Message and data rates may apply" disclosure must be provided at opt-in

Opt-Out Handling:

  • Opt-out requests (STOP, UNSUBSCRIBE, CANCEL, END, QUIT) must be honored immediately
  • Recipients who opt out must not receive further messages from that campaign

  • Misleading or non-compliant campaigns may be suspended or terminated by carriers
  • You are responsible for maintaining compliance with evolving carrier requirements and industry standards
6.5 Sharing of Telephone Data

We do not sell, rent, or lease telephone numbers or customer lists to third parties.

Mobile Information Protection:

  • No mobile information will be shared with third parties or affiliates for marketing or promotional purposes
  • Text messaging originator opt-in and consent information will not be shared with any third parties
  • All other categories exclude text messaging originator opt-in and consent; this information will not be shared with any third parties

Limited Sharing for Service Delivery:

  • Telephone numbers are shared only with communications service providers (carriers, messaging platforms) as necessary to deliver messages you have requested or consented to receive
  • These service providers are contractually prohibited from using your information for any purpose other than facilitating message delivery
